Agreement to Terms

These Terms and Conditions constitute a legally binding agreement made between you, whether personally or on behalf of an entity ("you"), and Digital Links ("we," "us," or "our"), concerning your access to and use of the digitallinks.in website as well as any other media form, media channel, mobile website, or mobile application related, linked, or otherwise connected thereto (collectively, the "Site").

User Representations

• You are not a minor in the jurisdiction in which you reside

Service Agreement and Payment Terms

Payment Terms

Cancellation and Refunds

• Project-based services are non-cancellable once work has commenced
• Refunds are provided only in cases explicitly outlined in your service agreement
• No refunds will be issued for services already rendered

Client Responsibilities

• Respond to requests for information and feedback within agreed timeframes

• Review and approve deliverables within specified timeframes

Intellectual Property Rights

Upon full payment, you will own the rights to deliverables created specifically for you as outlined in your service agreement. We retain the right to use work samples for portfolio and marketing purposes unless otherwise agreed in writing.

Service Level and Performance

While we strive to deliver exceptional results, we make no guarantees regarding:

• Specific search engine rankings or positions
• Exact traffic volumes or conversion rates
• Social media follower counts or engagement metrics
• Revenue or sales figures
• Timeline for achieving results, as digital marketing outcomes depend on numerous factors beyond our control

We commit to using industry best practices and dedicating our expertise to achieve the best possible outcomes for your business.

Confidentiality

Both parties agree to maintain the confidentiality of any proprietary or confidential information shared during the course of our business relationship. This includes but is not limited to:

• Business strategies and plans
• Financial information
• Customer data and lists
• Technical information and processes
• Marketing strategies and campaigns

This obligation continues even after the termination of our service agreement.

Limitation of Liability

To the fullest extent permitted by law, Digital Links shall not be liable for:

• Any indirect, incidental, special, consequential, or punitive damages
• Loss of profits, revenue, data, or business opportunities
• Damages resulting from third-party actions or platform changes
• Damages exceeding the amount paid by you for services in the 12 months preceding the claim

This limitation applies regardless of the legal theory upon which the claim is based.

Indemnification

You agree to defend, indemnify, and hold us harmless from and against any claims, damages, obligations, losses, liabilities, costs, or expenses arising from: (1) your use of the Site; (2) your violation of these Terms and Conditions; (3) your violation of any third-party rights, including intellectual property rights; or (4) any content or information you provide to us.

Third-Party Services and Platforms

Our services often involve third-party platforms such as Google, Facebook, Instagram, and others. We are not responsible for:

• Changes to third-party platform policies, algorithms, or features
• Account suspensions or penalties imposed by third-party platforms
• Service interruptions or technical issues with third-party platforms

You are responsible for maintaining compliance with all third-party platform terms of service.

Prohibited Activities

Modifications to Terms

Your continued use of the Site after any such changes constitutes your acceptance of the new Terms and Conditions.

Severability
